CITY OF DAYTON ORDINANCE AMENDING SECTION 93.70 


On June 3, 2020, the City of Dayton adopted an amendment of Section 93.70 Landlords and Tenants of the Revised Code of General Ordinances.  

(a) Limitation of Fees Charged by Landlord.  If a rental agreement includes a provision that authorizes the landlord to assess the tenant a fee for late payment of the monthly rent, the total amount may not exceed the larger of: $25.00; or 5% of the monthly contract rent.

(b) Rental Receipts.  When a tenant pays rent or a security deposit by cash or money order, the landlord shall provide a signed receipt.

Electronic payments (ACH and Credit Card) are not subject to this ordinance.  While this might create an additional administrative burden on your operations, we recommend following the best practices in the industry which include not accepting cash and moving toward accepting electronic payments ONLY.  There are services available such as CheckFreePay and Greendot which allow your residents to pay rent by money order or cash at a retail location and the payment is deposited directly into your bank account.  We recommend consulting with your software or payment provider to see what options might be available.
